Notice of Privacy Policies and Practices

To Protect Your Health Information

Bountiful Counseling is required to provide this notice to you by the Health Insurance Portability and Accountability Act (HIPAA). This notice describes how psychological and medical information about you may be used and disclosed and how you can get access to this information in accordance with the HIPAA Privacy Rule. Please review it carefully.

It is our legal duty to safeguard your protected health information (PHI). By law, we are required to ensure that your PHI is kept private.

I. Uses and Disclosures for Treatment, Payment, and Healthcare Operations

Bountiful Counseling may use or disclose your protected health information (PHI) for treatment, payment and healthcare operations purposes without your consent. To help clarify these terms, here are some definitions:

"PHI" refers to information in your clinical record that could identify you.

"Treatment, Payment and Healthcare Operations"

  • Treatment is when we provide, coordinate or manage your healthcare and other services related to your healthcare. An example of treatment would be when we consult with another healthcare provider, such as your family physician or another therapist.
  • Payment is when we obtain reimbursement for your healthcare. Examples of payment are when we disclose your PHI to a billing service to process healthcare claims, or to your health insurer to obtain reimbursement for your healthcare or to determine eligibility or coverage.
  • Healthcare Operations are activities that relate to the performance and operation of our practice. Examples of healthcare operations are quality assessment and improvement activities, business-related matters such as audits and administrative services, and case management and care coordination.

"Use" applies only to activities within our office, such as sharing, applying, utilizing, examining and analyzing information that identifies you.

"Disclosure" applies to activities outside of our office, such as releasing, transferring, or providing access to information about you to other parties.

II. Uses and Disclosures Requiring Authorization

Bountiful Counseling may use or disclose PHI for purposes outside of treatment, payment and healthcare operations when your appropriate authorization is obtained. An "authorization" is written permission above and beyond the general consent that permits only specific disclosures. In those instances where we are asked for information for purposes outside of treatment, payment or healthcare operations, we will obtain an authorization form from you before releasing this information. We document all uses and disclosures with client authorization in your clinical record.

We will also need to obtain a valid, written authorization before releasing your psychotherapy notes, unless otherwise required by law. "Psychotherapy notes" are notes we have made about our conversation during an individual, group, couple or family session. These notes are given a greater degree of protection than PHI. Psychotherapy notes are kept separate from the PHI in your Clinical Record.

Bountiful Counseling uses and discloses PHI only as permitted by the Privacy Rule, including the "minimum necessary requirement," and in accordance with state law. When using, disclosing or requesting PHI, we make reasonable efforts to limit PHI to the minimum necessary to accomplish the intended purpose. The "minimum necessary requirement" does not apply when client authorization is given, or for uses and disclosures as required by law or for compliance with the Privacy Rule.

You may revoke all such authorizations (of PHI or psychotherapy notes) at any time, provided each revocation is in writing. You may not revoke an authorization to the extent that (1) we have already relied on that authorization; or (2) if the authorization was obtained as a condition of obtaining insurance coverage, and the law provides the insurer the right to contest the claim under the policy.

III. Uses and Disclosures with Neither Consent nor Authorization

We may use or disclose PHI without your consent or authorization in the following circumstances:

  • Mandated Reporting of Abuse or Neglect: If we believe that a child, elderly person or disabled person is being abused or neglected, we are required to report this to the appropriate authorities or the police.
  • To Avert a Serious Threat to Health or Safety: For example, if you communicate to your therapist an explicit threat to kill or inflict serious bodily injury upon a reasonably identifiable person, and you have the apparent intent and ability to carry out that threat, we have the legal duty to take reasonable precautions. These precautions may include disclosing relevant information from your mental health records which is essential to protect the rights and safety of others. In addition, we may disclose PHI about you to disaster relief agencies to assist in disaster relief efforts.
  • For Health Oversight: For example, if you file a complaint against your therapist with the Utah Division of Occupational and Professional Licensing, we may disclose to them information from your records relevant to the complaint.
  • Required for Judicial or Administrative Proceedings: For example, if you are involved in a court proceeding and a request is made for information about the professional services that we have provided you and/or the records thereof, such information is privileged under state law, and we must not release this information without written authorization from you or your personal or legally appointed representative, or a court order. This privilege does not apply when you are being evaluated for a third party or when the evaluation is court ordered. We will inform you in advance if this is the case.
  • For Specific Government Functions: We may disclose PHI about you to federal officials for intelligence, counterintelligence and other national security activities authorized by law.
  • For Public Health Activities: For example, if we become aware that you or a reasonably identifiable person has a communicable disease, we are required to notify state or local health authorities. Or to use another example, in the event of your death, we may need to give PHI to a coroner or medical examiner.
  • For Worker's Compensation Purposes: If you file a worker's compensation claim, we must, upon appropriate request, furnish a copy of your Clinical Record to the appropriate parties, your employer, the employer's workers' compensation insurance carrier, or the Labor Commission.
  • Other Disclosures specifically required by law, or by law enforcement entities.

Bountiful Counseling documents all uses and disclosures of PHI without consent or authorization in your Clinical Record.

IV. Client's Rights and Therapist's Duties

Client's Rights:

  • Right to Request Restrictions: You have the right to request restrictions on certain uses and disclosures of PHI about you. However, we are not required to agree to a restriction you request. On your request, we will discuss with you the details of the restriction request process.
  • Right to Receive Confidential Communications by Alternative Means and at Alternative Locations: You have the right to request and receive confidential communications of PHI by alternative means and at alternative locations. (For example, you may not want a family member to know that you are being seen for treatment. Upon your written request, we will send you bills to another address.)
  • Right to Inspect and Copy: You have the right to inspect and/or obtain a copy of PHI in our clinical and billing records used to make decisions about you for as long as the PHI is maintained in the record. We may deny access to PHI under certain circumstances, but in some cases, you may have this decision reviewed. On your request, we will discuss with you the details of the request and denial process.
  • Right to Amend: You have the right to request an amendment of PHI for as long as the PHI is maintained in the clinical record. We may deny your request. On your request, we will discuss with you the details of the amendment process.
  • Right to an Accounting of Disclosures: You generally have the right to receive an accounting of disclosures of PHI regarding you. On your request, we will discuss with you the details of the accounting of disclosures process.

V. Therapist's Duties

Bountiful Counseling is required by law to maintain the privacy of PHI and to provide you with a Notice of our legal duties and privacy practices with respect to PHI.

We reserve the right to change the privacy policies and practices described in this Notice. Unless we notify you of such changes, however, we are required to abide by the terms currently in effect.

If we revise our privacy policies and procedures, we will provide you with a revised Notice either in person or by mail.

To protect the privacy of the PHI of our clients, we have in place appropriate administrative, technical, and physical safeguards, in accordance with the Privacy Rule.

We meet relevant state laws and the Privacy Rule's requirements regarding documentation.

VI. Business Associates

Bountiful Counseling relies on certain persons or other entities, who are not our employees, to provide services on our behalf, including billing services, accountants, lawyers and collection agencies. Where these persons or entities perform services which require the disclosure of individually identifiable health information, they are considered under the Privacy Rule to be our "business associates." Bountiful Counseling enters into a written agreement with each of our business associates to obtain satisfactory assurance that the business associate will safeguard the privacy of the PHI of our clients.

VII. Complaints

Paul Callister, CMHC is the appointed "Privacy Officer" for our practice per HIPAA regulations. We strongly believe in the importance of protecting the privacy of your health information. You may also send a written complaint to the Secretary of the U.S. Department of Health and Human Services at 200 Independence Avenue S.W., Washington, D.C. 20201. If you file a complaint about our privacy practices, we will not take retaliatory action against you.

VIII. Effective Date, Restrictions and Changes to Privacy Policy

This notice went into effect on May 9, 2018. We reserve the right to change the terms of this Notice and to make the new Notice provisions effective for all PHI that we maintain. We will provide you with a revised Notice in person or by mail.
